TERMS & CONDITIONS

You may use the Site for lawful personal, educational, research and other legitimate purposes.

You must not use the Site in a way that:

- violates applicable law or the rights of another person;
- interferes with the security or operation of the Site;
- introduces malicious software or other harmful content;
- deliberately provides false or misleading information;
- unlawfully obtains or distributes materials belonging to another person.
 

The contact form allows visitors to contact BJCH Center and, if they wish, submit photographs, documents, recordings or other materials for preliminary review.

By submitting materials, you confirm that:
- you are providing them voluntarily and in good faith;
- to the best of your knowledge, you are entitled to share them with BJCH Center for the purpose of review;
- the information you provide about your relationship to the materials is accurate to the best of your knowledge.

Submitting materials through the Site does not transfer ownership or copyright to BJCH Center and does not authorise BJCH Center to publish, distribute or include the materials in the Virtual Museum.

Submission does not guarantee that the materials will be accepted into the Digital Collection.

BJCH Center may review submitted materials, securely retain them while they are being considered, and contact the sender for additional information about their provenance, authorship, rights status, contents or the persons represented or referred to in them.

If BJCH Center wishes to include submitted material in the Virtual Museum, the relevant rights, permissions, conditions of use, attribution and public access will be addressed separately with the contributor.

This will normally be documented through a Contributor Release and Grant of Non-Exclusive License and its accompanying documentation.

No material submitted through the contact form will be treated as licensed for public use merely because it has been submitted to BJCH Center.

Materials available through the Virtual Museum may have different copyright and other rights statuses.

Where applicable, an individual item may be accompanied by a licence, rights statement, attribution or other information indicating how that item may be used.

Users are responsible for observing the rights information associated with each item.

The fact that material is publicly accessible through the Site does not, by itself, mean that it is free from copyright, privacy, image-rights, personal-data or other legal restrictions.

Any specific licence or rights statement displayed with an individual item governs the permitted use of that item.

Unless otherwise indicated, the Site’s design, original texts, graphics, branding and other content created by or for BJCH Center are protected by applicable intellectual-property laws.

Nothing in these Terms grants users permission to reproduce or distribute such content beyond what is permitted by applicable law or expressly authorised by BJCH Center.

This provision does not change or override the separate rights status or licence displayed for individual items in the Virtual Museum.

BJCH Center takes reasonable steps to review available information concerning provenance, rights and privacy before making materials available through the Virtual Museum publicly accessible.

Because the Virtual Museum contains historical materials, some rights information, identification or contextual information may be incomplete, uncertain or previously unknown.

If you:
- are a copyright or other rights holder;
- are depicted, identified or referred to in material available through the Virtual Museum;
- represent a person whose rights may be affected; 
- or otherwise believe that material has been published inaccurately or in a way that affects legal or privacy rights,

please contact bjch.center@gmail.com.

Please identify the relevant material and, where possible, explain your relationship to it and the nature of your concern.

BJCH Center will review such requests in good faith.

Where appropriate, BJCH Center may temporarily restrict access while a matter is being reviewed and may subsequently:

- correct or supplement information;
- modify attribution;
- anonymise or redact information;
- restrict public access; 
- or remove material from public access.

Nothing in this section constitutes an admission that a particular publication infringes any right.

BJCH Center aims to present Digital Collection and historical information responsibly and accurately.

However, historical records may contain incomplete, uncertain, conflicting or subsequently corrected information.

BJCH Center may amend descriptions, metadata, attribution and contextual information where new or more reliable information becomes available.

BJCH Center aims to keep the Site accessible and functioning properly but cannot guarantee uninterrupted availability or that the Site will always be free from technical errors.

The Site may contain links to websites or services operated by third parties. BJCH Center is not responsible for the content, privacy practices or operation of external websites.

To the extent permitted by applicable law, BJCH Center is not responsible for losses arising solely from temporary unavailability of the Site, technical errors, or the independent actions of third-party websites or services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Personal data submitted through or otherwise processed in connection with the Site are handled in accordance with the Privacy Policy.

BJCH Center may update these Terms when the Site, the Virtual Museum, or its services change.

The current version and the date of its latest update will be published on this page.

These Terms are governed by the laws of Poland, without prejudice to any mandatory rights that may apply under applicable law.
